Medical liability in law ''Medical Misconduct''
Dr. Asma'a Hassan Mohamed
Medical Misconduct: It is abnormal behavior customary, legal, and religious issued by one of the members of the medical profession towards other people. There are six acts identified by the British Medical Council Act as a disgraceful behavior that carries a penalty of erasure from the record of doctors and begins with the letter A in English, so that many of the position laws have criminalized these acts as follows: 1) Abortion: Here, it means criminal abortion; any termination of pregnancy or disposal of the fetus without a convincing medical reason. The laws of practicing the medical profession in many countries stated that a doctor may not perform an abortion or prescribe a medication that would abort the fetus, but if there is a risk to the life of the pregnant women when the pregnancy countries, then the abortion may be performed under certain conditions. 2) Adultery: It is intended to exploit the doctor for therapeutic relationship and confidence so that it ends in adultery or outrageous behavior with the patient or a member of his family. The doctor like other peoples, is subjected to criminal punishment with an emphasis on it. Proof of this crime also lead to the removal of the doctor's name from the union's record. 3) Addiction to alcohol: The British Medical Council believes that the abuse of alcohol may become a cause of erasure, especially in the case of frequent use of intoxicant and should presumably apply the penalty of wiping from the record of the union when seizing the doctor in the case of abuse of intoxicating alcohol and clearly between his workplace. 4) Addiction: Occasionally, some medical professionals are addicted to narcotic drugs that are used in the treatment of patients, especially as it is easier for them to obtain by virtue of their profession. In such cases, the doctor must be suspended from work to protect patients and keep them away from the source of these drugs so that they do not continue to take them. The doctor or pharmacist should also be careful in prescribing or giving narcotic drugs to patients so as not to be involved in the issue of diversion or trade in narcotic substances or to be accused of enabling those who are not entitled to obtain them. 5) Association: The employment of unqualified personnel and their presentation to patients through a clinic or hospital as a doctors, pharmacists or professionals as a crime of forgery punishable by law.
6) Advertisement: Some doctors, pharmacists and medical professionals compete away from the ethics of legitimate propaganda. Despite the legalization of some laws to announce the opening of medical clinics or change their location or times in a public notice board or newspaper. But, medical ethics deplores this because it may suggest promotion or propaganda. The correct way is to communicate directly with patients registered in the clinic, either by correspondence, telephone, or internet and inform them of these changes or information.
