Criminal Liability Resulting from Publishing News, Photos, or Comments through Electronic Means

Publishing private photos, comments, or news through electronic means in Iraqi law is considered one of the most serious forms of infringement on the right to privacy in the digital age. This is due to the speed of dissemination provided by social media and modern technologies, the wide scope of access, and the difficulty of controlling content once it has been circulated. The legal framework governing this crime in the Iraqi Penal Code is Article (438), which states: "A person shall be punished by imprisonment for a period not exceeding one year, or by a fine not exceeding one hundred dinars, or by one of these two penalties, if: (1) they publish, by any means of publicity, news, pictures, or comments relating to the secrets of individuals’ private or family life, even if they are true, if their publication is likely to cause offense to them." Based on the above, and in the absence of a specific cybercrime law addressing the crime of publishing photos, news, and comments through electronic means, Article (438/1) constitutes the legal basis relied upon by courts to cover cases involving the publication of such materials through electronic media. The material element of this crime is represented by the act of publication or dissemination through an electronic medium, while the moral element consists of criminal intent, represented by the perpetrator’s knowledge of the private nature of the content and their willful intention to publish it. In addition, there must be a condition of harm or offense inflicted upon the victim. The criminal liability for the offense of publishing private photos, news, or comments is imprisonment for a period not exceeding one year, a fine not exceeding one hundred dinars, or one of these two penalties, according to Article (438) mentioned above. In our view, the penalty for this crime does not correspond to the seriousness of the act, especially since such crimes may result in significant harm due to the disclosure of matters related to private family life.
