In the digital age, protecting intellectual property rights has become more important than ever, due to the widespread availability of digital content and the ease of copying and sharing it online. Copyright, according to Iraqi Copyright Law No. 3 of 1971, Is an Inherent right of the creator to control their intellectual work and prevent any unauthorized exploitation. The law also imposes penalties on those who engage In plagiarism or imitation, as Article 16 of the same law states: “Anyone who unlawfully uses a work protected by copyright without permission shall be subject to a fine, imprisonment, or both.”
With the spread of the internet and digital platforms, new challenges have emerged in applying these provisions, particularly when works are shared among users without proper oversight. In many cases, identifying the offender or proving the violation becomes difficult, highlighting the need to develop legislation that keeps pace with modern technology. For instance, Article 23 of the Copyright Law provides a framework for protecting digital works, including electronic contracts and online usage licensing.
Moreover, legal awareness plays a crucial role in safeguarding these rights. Universities and cultural institutions can educate students and creators about their rights and obligations, referring to Article 14 of the law, which grants the injured party the right to seek compensation for damages resulting from any infringement. International cooperation also contributes to combating digital piracy, as agreements like the WIPO (World Intellectual Property Organization) Convention include clear provisions to strengthen the protection of intellectual property across countries.
In conclusion, protecting intellectual property rights in the digital age is not only the responsibility of individuals but requires the combined efforts of governments, educational institutions, and technology providers. Ensuring the proper application of legal provisions is essential to safeguard creators’ rights and encourage innovation and creativity in society.
