Environmental Protection in Investment Law No. 13 of 2006

Dr. Qasim Mohammed Al-Haims<br />Faculty of Law – AL-Mustaqbal University<br /><br />In recent years, the environment has faced numerous risks that threaten the lives of living organisms, including humans. These risks are largely attributed to the harmful effects of industrial machinery, which can cause injuries or fatalities. Many Iraqi legislations have addressed this issue, including Iraqi Investment Law No. 13 of 2006, which explicitly mentions environmental protection in Article 14. This article outlines the obligations of investors, including preserving environmental safety, adhering to Iraq’s quality control regulations, complying with internationally recognized environmental standards, and following laws related to security, health, public order, and Iraqi societal values.<br /><br />The importance of environmental protection becomes particularly evident when discussing investment projects, as these projects inherently rely on machines and equipment powered by fuel, which is often environmentally harmful. This necessitates precautionary measures to mitigate the adverse effects of such machinery.<br /><br />The explicit legal requirement for investors to preserve environmental safety, alongside their other obligations, is a commendable measure. In this regard, a recommendation is made to the National Investment Authority to issue new regulations that effectively contribute to environmental protection and pollution prevention. These regulations should be stringent enough to ensure compliance but not excessively burdensome to the extent that they hinder the implementation of investment projects.<br /><br />Sustainable Development Goals (SDGs) Addressed:<br />This article aligns with SDG 13: Climate Action and SDG 15: Life on Land, emphasizing the need to mitigate industrial environmental damage and ensure the sustainability of natural resources within investment projects.<br /><br />AL-Mustaqbal University<br /><br /><br /><br /><br /><br /><br /><br /><br />
