Artistic creativity is one of the most important forms of human expression, reflecting the identity, culture, and aesthetic and intellectual values of societies. It plays a vital role in the development of human awareness and the advancement of civilization. With the growth of societies and the expansion of production and publishing platforms, protecting artistic creativity has become an urgent necessity to safeguard artists’ rights and prevent exploitation or infringement. Under modern legislation, laws related to intellectual property rights have witnessed significant development, providing protection for artistic works in their various forms, including painting, sculpture, design, architecture, digital arts, and other creative fields. These legislations aim to achieve a balance between freedom of creativity, public access to knowledge, and the protection of artists’ moral and economic rights. The importance of modern legislation lies in providing a clear legal framework that ensures proper attribution of artistic works to their original creators and prevents illegal copying, infringement, and distortion. It also regulates mechanisms of publishing, exhibiting, and commercial use of artworks, thereby encouraging artists to innovate and produce confidently within a supportive and rights-respecting environment. With the widespread use of digital technologies and social media platforms, new challenges have emerged related to the unauthorized use and reproduction of artistic works, highlighting the need to update legislation in line with technological advancements to protect creativity in the digital space. This underscores the importance of legal awareness among artists and cultural institutions regarding intellectual property rights and protection mechanisms. Protecting artistic creativity aligns with the Sustainable Development Goals, particularly Goal 4 (Quality Education) by promoting legal and creative awareness within society, and Goal 16 (Peace, Justice, and Strong Institutions) by reinforcing the rule of law, ensuring justice, and safeguarding the intellectual rights of creators. Thus, modern legislation contributes to building a fair and sustainable cultural environment that supports creativity and preserves artistic and human values.
